§ 305. Modification of Dimensional Standards in Subdivisions

  • A. In subdividing land, in order to allow boundaries to coincide with stone walls or other historical landscape features, as long as the aggregate number of lots allowed under conventional subdivision is not exceeded and as long as the average lot size of the subdivision meets the minimum lot area standard for the zone, individual lots may be modified. In Residential Zone A and Residential Zone B, the standards for minimum lot area and minimum setbacks shall be modified as follows:

    1. Up to twenty percent (20%) less than the minimum lot area of the zone for land not bounded by a Town road or State highway; and,

    2. Up to ten percent (10%) less than the minimum lot area of the zone for land bounded by a Town road or State highway.

    B. Dimensional standards to be applied to cluster subdivisions shall be those established by the Planning Board at the time the cluster subdivision was approved. If the applicable dimensional standards are not set forth on the recorded plan, or in a written decision of the Planning Board, then the dimensional standards in the Zoning Ordinance, or Subdivision Regulations, applicable to the cluster subdivision which were in effect at the time the cluster subdivision development was approved shall be applied.
